Our lawyer, Fernanda Saavedra Renard, published an opinion column in El Mercurio Legal, where she explains and questions the use of step clauses, such as the arbitral procedure, which has become a common practice for resolving contractual disputes. However, from her perspective, its application remains uncertain.

“Even when step clauses have had some development, their application doesn’t seem quite clear. This happens both in domestic and international arbitration, where there is still uncertainty about its applicability in arbitral proceedings conducted under the New York Convention and the Singapore Convention”; emphasizes Fernanda.
